Dinkum Terms of Service

1. About Dinkum
Dinkum (dinkum.services) is an online marketplace operated by Wallaby Group Pty Ltd (ABN 26 695 980 735) that connects clients with independent service providers. By creating an account, you agree to these terms.
2. Dinkum is a platform, not an employer or certifier
Dinkum does not employ, supervise, or control any service provider listed on this platform. Service providers are independent operators who have chosen to advertise their services here.
Dinkum does not verify, check, or confirm the qualifications, licences, certifications, registrations, or insurance of any service provider. Information providers supply about their qualifications and insurance is self-reported and has not been independently verified by Dinkum.
A listing on Dinkum is not an endorsement, recommendation, or certification of any provider. Dinkum does not vet the identity, background, conduct, or legal compliance of any user, and does not conduct police, background, or character checks.
Where Dinkum verifies an email address or mobile number, that verification confirms only that the address or number is functional and controlled by the account holder at the time of the check. It is not identity verification and not vetting of any kind.
It is the responsibility of clients to satisfy themselves that any provider they engage holds the qualifications, licences, and insurance appropriate for the work to be performed. For licensed trades (such as electrical, plumbing, and gas work), clients should ask providers to confirm their licence number and verify it independently with the relevant authority.
3. Right to work
If you offer or perform services through Dinkum, you confirm that you are legally entitled to work in Australia and to provide those services, and that doing so does not breach any condition of a visa you hold — including any limit on the number of hours you may work, or on how long you may work for a single client. Keeping within your visa and work-rights conditions is your responsibility. Dinkum does not check, verify, or confirm the visa status or work rights of any user, and does not represent that it does.
4. Contracts are between clients and providers
Any agreement for services is made directly between the client and the provider. Dinkum is not a party to that agreement and accepts no responsibility for the performance, quality, safety, or outcome of any services arranged through the platform.
5. No guarantee of availability or accuracy
Dinkum does not guarantee that any provider is available, that their profile information is current or accurate, or that they will respond to enquiries. Profile content is created and maintained by providers, whether written by them directly or drafted with the help of Dinkum's profile tools, including the AI Assistant. The provider is responsible for everything published on their profile, however it was drafted, and confirms it is accurate and not misleading.
6. Reviews
Reviews on Dinkum are submitted by platform users. Dinkum does not verify the accuracy of reviews and is not responsible for their content. Reviews reflect the personal experience of the reviewer only. Dinkum may moderate, edit the display of, or remove reviews at its discretion, but has no obligation to monitor them.
7. Your content
By uploading or publishing content on Dinkum — including profile text, photos, business details, and reviews — you grant Wallaby Group Pty Ltd a non-exclusive, royalty-free, worldwide licence to host, display, and reproduce that content for the purpose of operating and promoting the platform. You confirm you own or have the right to share any content you upload, and that it does not infringe anyone else's rights.
8. Payments and tax
Dinkum does not process, hold, or transmit payments between users, and does not set, collect, or guarantee any price or payment. All payment arrangements are made directly between the client and the provider. Providers are solely responsible for their own tax, GST, superannuation, and record-keeping obligations arising from work they perform.
9. Disputes between users
Dinkum is not a party to any agreement between a client and a provider and has no obligation to mediate, arbitrate, or resolve disputes between users. Users should attempt to resolve disputes directly, and may have remedies under the Australian Consumer Law or through their local fair trading authority or tribunal.
10. Eligibility and account security
You must be at least 18 years old to create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Tell us promptly via the Contact Dinkum form if you believe your account has been compromised.
11. Conduct
Users must treat each other with respect and must not use Dinkum to harass, deceive, threaten, or defraud anyone. Conduct of that kind is a breach of these terms and may lead to removal under section 14.
12. No scraping or systematic extraction
You must not use automated tools, scripts, or any systematic process to extract, copy, or harvest user data, provider listings, or other content from Dinkum for any commercial purpose. This does not restrict normal use of the platform.
13. Service availability
Dinkum does not guarantee that the platform will be available at any particular time or that it will operate without interruption, error, or data loss. Wallaby Group Pty Ltd may suspend access or take the platform offline for maintenance, security, or operational reasons. If we decide to discontinue the platform permanently, we will give reasonable notice where practicable so that users can keep copies of their own information.
14. Right to remove users
Wallaby Group Pty Ltd may suspend or deactivate an account where we reasonably believe the account holder has breached these terms, behaved abusively or dishonestly, poses a risk to other users, to the platform, or to Dinkum's reputation, or where we are required to by law. That assessment is ours to make, in good faith, based on the information available to us — including complaints from other users. We may act immediately and without prior notice, and will tell the account holder the general reason where practicable. We are not obliged to reinstate a removed account. If an account is removed, content associated with it may also be removed.
15. Modification of the service
Dinkum may change, add, or remove features and functionality as the platform develops.
16. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. The Indemnity and Limitation of liability sections below apply subject to this section. Where liability under a non-excludable guarantee can lawfully be limited, it is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.
17. Indemnity
You agree to indemnify Wallaby Group Pty Ltd, its directors, and its representatives against any claim, loss, damage, cost, or liability (including reasonable legal costs) arising from your breach of these terms, content you upload or publish, your unlawful conduct, or any services you provide or receive through the platform. This indemnity does not apply to the extent that a claim, loss, or liability is caused by Wallaby Group Pty Ltd's own negligence or breach of these terms, and it is reduced proportionally to the extent that we contributed to the loss.
18. Limitation of liability
To the maximum extent permitted by Australian law, Dinkum's liability to you for any cause whatsoever is limited to the amount you have paid to Dinkum in the 12 months preceding the claim, or $100, whichever is greater. Dinkum is not liable for indirect, consequential, or incidental loss of any kind.
19. Privacy
Dinkum collects and holds personal information in accordance with the Australian Privacy Act 1988. We do not sell your personal information to third parties. See our Privacy Policy for full details.
20. Changes to these terms
Dinkum may update these terms from time to time. If a change is material, we will give reasonable notice before it takes effect — by email or by a notice on the platform. Changes apply from their effective date and do not apply to anything that happened before it. If you do not agree to updated terms, you may stop using the platform and close your account.
